Each individual may hold only one (1) ph38 account. Duplicate accounts are strictly prohibited. You are solely responsible for maintaining the confidentiality of your ph38 login credentials, including your username, password, and any one-time passwords (OTPs) sent to your registered mobile number. ph38 will never ask for your password through any communication channel. Any activity that occurs on your account while you are logged in, or using your credentials, is your responsibility. Account Sharing Prohibited: Sharing, transferring, or selling access to a ph38 account is strictly prohibited and constitutes grounds for immediate account suspension and forfeiture of any account balance or pending winnings.
ph38 is required under PAGCOR regulations and applicable Philippine anti-money laundering laws — including Republic Act No. 9160 (the Anti-Money Laundering Act, as amended) — to conduct Know Your Customer (KYC) verification on all player accounts before processing withdrawal requests.

All Promotions are subject to the specific terms and wagering requirements communicated at the time the Promotion is offered, which form part of these Terms and Conditions.

ph38 does not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. ph38 makes no warranty regarding the suitability of any game, promotion, or service for any particular purpose. Participation in ph38 games involves financial risk — players may lose the entirety of their deposited funds.
Force Majeure: ph38 shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond ph38's reasonable control, including acts of God, government actions, telecommunications failures, natural disasters, or civil disturbance.
ph38's collection, use, storage, and protection of your personal data is governed by the ph38 Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what data ph38 collects, how it is used, with whom it is shared, and how it is protected, in accordance with the Philippine Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules and regulations.
By creating a ph38 account, you consent to ph38's processing of your personal data as described in the Privacy Policy. You have the right to access, correct, and request deletion of your personal data, subject to ph38's legal data retention obligations under PAGCOR regulations and the Anti-Money Laundering Act.
In the event of any dispute between you and ph38 relating to your use of the platform, your account, any game outcome, or any transaction, ph38 encourages you to contact the ph38 support team in the first instance at [email protected] or via live chat. ph38 will acknowledge formal disputes within five (5) business days and aims to resolve them within twenty-eight (28) calendar days of receipt of all necessary information.
If a dispute cannot be resolved through ph38's internal process, and the matter falls within the regulatory jurisdiction of PAGCOR, the player may escalate the matter to PAGCOR through its official regulatory channels. ph38 will cooperate fully with any PAGCOR inquiry or investigation arising from a player dispute.
ph38 reserves the right to withhold disputed amounts from withdrawal pending resolution of the relevant dispute. ph38 will not withhold undisputed amounts from withdrawal during the dispute resolution period unless a separate regulatory instruction requires it to do so.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, including applicable PAGCOR regulations, the Civil Code of the Philippines, the Data Privacy Act of 2012, and the Anti-Money Laundering Act of 2001 as amended.
Any legal proceedings arising out of or in connection with these Terms that cannot be resolved through the dispute resolution process described in Section 15 shall be subject to the exclusive jurisdiction of the competent courts of the Philippines, without prejudice to the rights of PAGCOR as the relevant regulatory authority.
ph38 reserves the right to amend, update, or replace these Terms and Conditions at any time at its sole discretion. Amendments will be communicated to players through one or more of the following methods: a notice posted on the ph38 website or platform, an email notification to the player's registered email address, or an in-platform notification displayed at next login.
Amendments take effect on the date published unless a specific effective date is stated. Your continued use of the ph38 platform after the effective date of any amendment constitutes your acceptance of the revised Terms.
